Thanks for that, Brick. That answers several questions I had.

I hope Special Master Dearie doesn't resign. My fear is Judge Cannon would just find someone more sympathetic to Trump. I hope DOJ asks the 11th Circuit to remove her.

You’re welcome, Robbie. I had the same questions.

I hope the 11th Circuit sees through the delaying tactics and puts a stop to them, preferably by reassigning her, removing her from the proceeding.

A Dearie resignation would cause another delay. Although I wouldn’t blame him, I hope he doesn’t. It must be difficult for an accomplished jurist to watch the Trump team make a mockery of the process that it demanded.

I apologize for being late getting back.

A Circuit Court may remove a District Judge from hearing a same case again, which was what the 5th Circuit did in a case which led to the Judge having some sort of discipline. I'm not sure that I was out of law school at that time.

I feel pretty sure that this is the right place for this. Readers have asked Ms. Vance about what happens when a client is lying as well as the attorney representing him or her. This is as good as it gets.

Joyce Vance on the issue.

I give her an A+.

The Walls Are Closing in on Trump's TRUTH Social.

quote:

Things aren’t looking good for Donald Trump’s social media platform TRUTH Social—despite the former president’s own bouts of rampant posting.

The fate of the social network is hanging in the balance, as delays continue to plague a $1.3-billion merger that would potentially secure its future. The latest delay came on Monday as a key vote was postponed to November, and some investors have already backed out.

TRUTH Social’s biggest problem is Trump himself, as TIME has previously reported, because his messages engage a more narrow audience than can sustain its business, according to politics and technology experts. That fact continues to hold true as Trump increasingly amplifies QAnon extremism on the platform. The site’s business prospects are deteriorating at the same time that Trump faces a slew of legal, financial, and political perils.

These mounting woes have all come together to create the perfect storm of chaos surrounding the planned merger between TRUTH Social parent Trump Media & Technology Group and blank-check company Digital World Acquisition Corp.

“This has been a very unpredictable deal,” says Kristi Marvin, the founder of data and analysis firm SPACInsider.

The arrangement is currently under investigation by the U.S. Securities and Exchange Commission (SEC). Digital World’s shareholders must vote to extend the merger’s deadline by a year in order to keep the deal alive.

Neither TRUTH Social nor Digital World responded to TIME’s requests for comment.

Trump Aide Was Seen on Security Footage Moving Boxes at Mar-a-Lago.

quote:

A long-serving aide to former President Donald J. Trump was captured on security camera footage moving boxes out of a storage room at Mar-a-Lago, Mr. Trump’s residence in Florida, both before and after the Justice Department issued a subpoena in May demanding the return of all classified documents, according to three people familiar with the matter.

The footage showed Walt Nauta, a former military aide who left the White House and then went to work for Mr. Trump at Mar-a-Lago, moving boxes from a storage room that became a focus of the Justice Department’s investigation, according to the people briefed on the matter. The inquiry has centered on whether Mr. Trump improperly kept national security records after he left the White House and obstructed the government’s repeated efforts to get them back.

As part of its investigation, the Justice Department has interviewed Mr. Nauta on several occasions, according to one of the people. Those interviews started before the F.B.I. executed a search warrant at Mar-a-Lago on Aug. 8 and carted off more than 11,000 documents, including about 100 that bore classification markings. Mr. Nauta has answered questions but is not formally cooperating with the investigation of Mr. Trump’s handling of the documents.

His lawyer, Stanley Woodward Jr., declined to comment. Taylor Budowich, a spokesman for Mr. Trump, accused the Biden administration of “colluding with the media through targeted leaks in an overt and illegal act of intimidation and tampering.”

The Washington Post reported on Wednesday that Mr. Trump directed an employee who had been interviewed by the F.B.I. to move boxes at Mar-a-Lago. It is not clear whether that employee was Mr. Nauta, and a person familiar with the matter and with Mr. Trump’s orbit said it could be a different staff member.

More on the Trump Documents Inquiry

Supreme Court Request: The Justice Department urged the justices to reject a request from former President Donald J. Trump asking the court to intervene in the litigation over documents seized from his Florida estate.

Documents Still Missing?: A top Justice Department official told Mr. Trump’s lawyers in recent weeks that the agency believed he had not returned all the records he took when he left the White House, according to two people briefed on the matter.

Christina Bobb: As Mr. Trump’s lawyer, the former Marine and far-right cable TV anchor went out on a limb for him. Now she is under scrutiny in the Justice Department’s criminal investigation.

Dueling Judges: The moves and countermoves by a federal judge and the special master she appointed reflect a larger struggle over who should control the rules of the review of the documents seized from Mar-a-Lago.

A top Justice Department official told Mr. Trump’s lawyers in recent weeks that the department believed he had still not returned all the documents. It is unclear if the boxes that were moved were among the material later retrieved by the F.B.I.

The National Archives, the federal agency that oversees presidential records, spent much of 2021 attempting to retrieve boxes of records that its officials had been told were in the White House residence at the end of the Trump presidency.

Read more here.

I have to believe that at least a few of Trump's lawyers could be facing sanctions if they had been in front of different Judges. Some, of course, did get sanctioned in their filings of "stop the steal" lawsuits. This is different in that at least some are aware of what Trump had kept since his term ended and may still have.

And yet another of Trump’s legal woes.

On Wednesday, a federal judge ruled that Donald Trump must sit for a deposition in a defamation case brought by E. Jean Carroll, a woman who says Trump raped her in the 1990s.

It gets even better!

The Jan. 6 committee voted to subpoena Donald Trump

quote:

The House committee investigating the attack on the Capitol voted unanimously to issue a subpoena to the former president to question him about his role in events that led to the violence that consumed Congress. It is unlikely, however, that lawmakers will have the chance to question Trump, who will all but certainly fight any demands in court.

The committee’s hearing today, which is expected to be its final one, revealed new footage showing for the first time how Congress’s top leaders scrambled to secure support from the Trump administration or National Guard as the Capitol came under attack.

The panel also showed how Trump repeatedly sought to join the crowd at the Capitol, even after his supporters had turned violent. “I think that was enough grounds for us to be alarmed,” a national security official told investigators.

Separately, the Supreme Court rejected a request from Trump to intervene in the litigation over documents seized from Mar-a-Lago. And an aide to Trump was seen on video moving boxes at Mar-a-Lago after the Justice Department issued a subpoena for documents.

This is from another one of my emails. I admit that I haven't found it on the paper yet, but I wanted to get this up. I'll add a link later if I find one.

Another evil hack takes aim at the most victimized man in the history of the world, Donald Trump.

U.S. District Judge David Carter ordered pro-Trump attorney John Eastman to turn over dozens of documents to the House select committee investigating the Jan. 6 Capitol riot.

Is everyone in the world involved in a deep state conspiracy to undo the great good that Donald Trump bestowed on this country? That’s what the grifter would have you believe. Amazingly, even as implausible as that notion really is, millions do believe it. That bothers me.

That's Trump's story and he's sticking with it.

I wonder how many of the True Believers are now so invested in it that they can't give it up for fear of loss of face.

Mar-a-Lago classified papers held U.S. secrets about Iran and China

Iran’s missile program, U.S. intelligence work aimed at China were among the most sensitive material seized by the FBI, people familiar with the matter say

By Devlin Barrett
Updated October 21, 2022 at 2:03 p.m. EDT|Published October 21, 2022 at 11:00 a.m. EDT

Some of the classified documents recovered by the FBI from Donald Trump’s Mar-a-Lago home and private club included highly sensitive intelligence regarding Iran and China, according to people familiar with the matter. If shared with others, the people said, such information could expose intelligence-gathering methods that the United States wants to keep hidden from the world.

At least one of the documents seized by the FBI describes Iran’s missile program, according to these people, who spoke on the condition of anonymity to describe an ongoing investigation. Other documents described highly sensitive intelligence work aimed at China, they said.

Unauthorized disclosures of specific information in the documents would pose multiple risks, experts say. People aiding U.S. intelligence efforts could be endangered, and collection methods could be compromised. In addition, other countries or U.S. adversaries could retaliate against the United States for actions it has taken in secret.

The secret documents about Iran and China are considered among the most sensitive the FBI has recovered to date in its investigation of Trump and his aides for possible mishandling of classified information, obstruction and destruction of government records, the people said.

The Trump Organization's Tax-Fraud Trial Is Starting. Here's What's at Stake.

quote:

The criminal tax-fraud trial of the Trump Organization begins on Monday, and the outcome could impact more than the coffers of former President Donald Trump’s family business.

The Manhattan District Attorney’s Office has charged two of the business entities within the Trump Organization—the Trump Corporation and Trump Payroll Corp.—with running a 15-year scheme to defraud tax authorities. Prosecutors allege that the scheme allowed certain executives to receive large portions of their compensation through disguised means, allowing them to underreport their income. The Trump Organization has pleaded not guilty and denied all wrongdoing. If found guilty, the companies could face stiff financial penalties.

Prosecutors also charged the Trump Organization’s longtime chief financial officer Allen Weisselberg, 75, with devising and operating the alleged scheme. On Aug. 18, Weisselberg pleaded guilty to all 15 felony counts, including conspiring with the Trump Organization. Weisselberg was sentenced to five months in jail and five years probation, contingent on his truthful testimony in the trial beginning Monday in New York City. (He also must pay nearly $2 million in taxes, penalties, and interest.) In an August statement, Manhattan DA Alvin Bragg said that Weisselberg’s plea implicated the Trump Organization in “a wide range of criminal activity.”

Neither Donald Trump nor any of his children have been charged by the Manhattan DA’s office with any wrongdoing. But the trial promises to reveal new insights into the inner workings of the company that dominated much of Trump’s pre-presidential life. The Trump Organization was built upon Trump’s brand of ‘80s-era bravado, helped launch Trump to fame, and was run by Trump himself for decades until he entered the White House in 2017. Trump then transferred control of the company into a trust run by Weisselberg and his sons Donald Trump Jr. and Eric Trump. (Weisselberg resigned after his indictment last summer.) The charges against the Trump Organization have emerged out of a years-long probe by the Manhattan DA’s office into Trump’s business dealings—a probe that Bragg pledged to continue in April. Court watchers will be listening to testimony in the trial for signs that more charges could emerge.

To win, prosecutors must convince a jury that Weisselberg acted within the scope of his employment and on behalf of the Trump Organization. If the defense successfully paints a picture of a few rogue executives lying on their taxes, the businesses could avoid conviction. The outcome will likely hinge on Weisselberg’s testimony.

Even if the Trump Organization is convicted, it might be a better situation for the Trump family than having the businesses plead guilty as Weisselberg did, says someone familiar with the inner workings of the Trump Organization who requested anonymity to speak candidly. “If convicted, Trump would rather it be by a jury, in a trial that he could blame as biased and flawed,” says the individual, “as opposed to authorizing a representative of the company to walk into court and admit guilt.”

The Manhattan DA’s probe is just one strand in a web of legal woes entangling the former President, who also faces federal investigations for allegedly removing potentially classified documents from the White House and working to overturn the results of the 2020 election. (Trump has denied all wrongdoing.) In September, New York Attorney General Letitia James also filed a $250 million lawsuit against Trump, his three oldest children, the Trump Organization, and senior management in the company including Weisselberg, alleging that they were involved in efforts to falsely inflate Trump’s assets by billions of dollars in order to mislead lenders and secure more favorable loans. James says that her office is cooperating with the Manhattan DA’s office and has also referred their findings to the U.S. Attorney’s Office for the Southern District of New York and the Internal Revenue Service for criminal investigations.

I don't see how they can ignore Trump's involvement in this prior to his run for and election to President.
